The Courts Share the Opinion of the Information Commissioner: Access to the E-mail Account of a Former Employee is Unlawful!

Employees are entitled to a certain right to privacy even at the workplace, despite the fact that the employer as the owner of working means (e.g. computers, mobile phones) has the right to oversee their usage as well as the right to detect and prevent the commission of disciplinary offences by its employees. The Information Commissioner is of the opinion that an interference with the right to privacy of employees at the workplace is only lawful if such interference is legitimate and proportionate to the objective pursued by the employer. A basis for the processing of all the personal data of employees without their explicit consent is not provided by law.

According to the Court of Justice of the European Union, time spent traveling to and from work can constitute working time

In case C-266/14 the European Court of Justice (ECJ) decided on the preliminary question of whether time spent traveling to and from work in the case of fieldwork amounts to “working time” within the meaning of Directive 2003/88/EC concerning certain aspects of the organisation of working time.
